These Gift Trip Terms & Conditions ("Gift Terms") govern the purchase of Bela Via, Inc. ("Bela Via") gift trips ("Gift Trips"). They apply in addition to the Bela Via Trip Terms & Conditions ("Trip Terms"), which govern the planning and execution of the trip itself upon redemption.

1. What You Are Buying

A Gift Trip is a service product entitling a named recipient (the "Recipient") to redeem a Bela Via surprise travel experience at the tier purchased. A Gift Trip is not a gift card, store credit, cash equivalent, or stored value of any kind. It has no cash value, cannot be redeemed for cash, and cannot be partially redeemed with any remaining balance returned, credited, or held.

2. Non-Refundable

All Gift Trip purchases are final and non-refundable under any circumstances. Bela Via does not issue refunds, partial refunds, or credits for cancellation, change of mind, failure of the Recipient to redeem, or any other reason. By completing payment, the purchaser ("Purchaser") expressly waives the right to dispute or chargeback the purchase. Bela Via will actively contest any chargeback and reserves the right to suspend or void the associated Gift Trip in the event one is initiated.

3. Non-Transferable

A Gift Trip may be redeemed only by the Recipient designated at the time of purchase. Gift Trips may not be sold, traded, gifted onward, or otherwise transferred. Bela Via may, at its sole discretion, permit reassignment to a different Recipient upon written request from the original Purchaser, but is under no obligation to do so.

4. Purchaser Authority

By purchasing a Gift Trip, the Purchaser represents they are at least eighteen (18) years of age and are authorized to make the purchase. The Purchaser is solely responsible for the accuracy of all information provided to Bela Via, including Recipient details and delivery instructions.

5. Redemption Governed by Trip Terms

Upon submission of the Bela Via redemption questionnaire by the Recipient, the planning and execution of the resulting trip are governed by the Trip Terms. The Recipient accepts the Trip Terms in full by submitting the questionnaire. These Gift Terms govern the purchase and the gift itself; the Trip Terms govern everything that follows.

7. Governing Law

These Gift Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any legal action arising out of these Gift Terms shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties consent to the personal jurisdiction and venue of such courts.
