These Terms & Conditions ("Terms") govern your use of the Bela Via, Inc. (referred to as "Bela Via," "we," "us," "our," or the "company") website and services. These Terms apply to all trips booked through Bela Via, including trips redeemed from a Bela Via Gift Trip. Gift Trip purchases are separately governed by the Bela Via Gift Trip Terms & Conditions. By accessing our website or making a booking, you acknowledge that you have authority to accept these Terms on behalf of yourself and all guests in your party, and that all guests agree to be bound by them.
1. Nature of Service
Bela Via designs and books surprise travel experiences based on information provided by the guest. By using our services, you acknowledge and accept the inherent uncertainty, subjectivity, and surprise element of the travel experience. Additionally, Bela Via is not liable and does not offer refunds or compensation if you feel the descriptions or preferences of any part of your trip did not align with the trip itself.
2. Booking Authorization
By submitting the Bela Via questionnaire and completing payment, you authorize Bela Via to book travel components on your behalf, including but not limited to flights, accommodations, and related services, in accordance with your stated preferences. By doing so, the guest enters into a binding agreement with Bela Via and acknowledges that all terms and conditions set forth herein are accepted in full. The guest is solely responsible for ensuring that all information submitted to Bela Via, including, without limitation, traveler details, passport information, dates, and preferences, is accurate and complete. Bela Via is not responsible or liable for any errors, omissions, or inaccuracies provided by the guest, or for any resulting costs, delays, or disruptions to travel.
3. Payment and Refund Policy
All sales are final. Due to the customized and surprise nature of our trips, Bela Via does not offer refunds under any circumstances once payment has been submitted. By completing payment, the guest explicitly acknowledges they have read, understood, and agreed to this non-refundable policy.
Full and confirmed payment is required before any trip details, documentation, or services will be released. In the event of a failed, declined, or reversed payment, Bela Via reserves the right to withhold all trip information and services until payment has been successfully received and confirmed. If a payment dispute is initiated and remains unresolved at the time of the scheduled departure date, the trip will be considered forfeited and Bela Via bears no obligation to reschedule, reimburse, or otherwise compensate the guest. If trip details have already been released prior to a dispute being initiated, the guest acknowledges that services have been fully rendered and no refund or compensation is owed.
The guest acknowledges that upon payment confirmation, Bela Via immediately begins securing non-refundable travel components on their behalf. Services are therefore considered rendered from the point of booking, regardless of whether travel is commenced or completed. Any chargeback or payment dispute initiated at any time, whether before, during, or after travel, will be actively contested by Bela Via. The guest expressly waives any right to dispute charges once payment has been submitted. Bela Via may provide any and all documentation demonstrating fulfillment of services to financial institutions or dispute resolution bodies, and reserves the right to pursue lawful recovery of any amounts owed.
If an emergency or unforeseen circumstance arises, guests are encouraged to contact Bela Via directly at triphelp@belaviatravel.com as soon as possible. Bela Via will review each situation individually and, at its sole discretion, may explore options such as rescheduling, though no accommodation is guaranteed. Bela Via strongly recommends that all guests purchase a travel insurance policy prior to their trip.
4. Third-Party Providers
Bela Via acts solely as a booking and planning agent. Travel services are provided by independent third parties such as airlines, hotels, tour operators, restaurants, and other transportation providers. Bela Via is not responsible for the acts, omissions, performance, or availability of these third parties. Bela Via makes no warranties regarding supplier descriptions or representations, including but not limited to room type, layout, bedding configuration, seat selection, aircraft type, in-flight services, amenities, or hotel classification, and shall not be liable for any variance or change. Bela Via makes no guarantees regarding specific destinations, properties, carriers, or travel components selected, and reserves the right to substitute comparable alternatives if a previously selected component becomes unavailable, discontinued, or otherwise unsuitable prior to or during travel. In the event a substitution is required, Bela Via will make a reasonable attempt to notify the guest via the email address on file and seek their approval. If the guest has not responded within 24 hours of notification, Bela Via reserves the right to make substitution decisions at its sole discretion. If the guest responds within 24 hours and rejects the proposed substitution, Bela Via will make reasonable efforts to identify an alternative; however, rejection of a substitution does not constitute grounds for a refund or compensation. Any substitution made under this section, whether approved, rejected, or made at Bela Via's discretion, does not constitute grounds for a refund or compensation.
5. Changes, Delays, and Disruptions
Bela Via is not liable for delays, cancellations, schedule changes, weather events, strikes, governmental actions, or other circumstances beyond our control. Any additional costs resulting from such events are the responsibility of the guest.
6. Guest Responsibility and Conduct
Guests are responsible for their own behavior and for complying with all applicable laws, regulations, and provider policies during travel. Bela Via is not responsible or liable for guest conduct, actions, or omissions, and assumes no responsibility for missed flights, no-shows, denied boarding, or unused services resulting from a guest's failure to appear or comply with provider requirements. Bela Via will not book travel to any destination currently rated "Level 3 — Reconsider Travel" or higher on the U.S. Department of State Travel Advisory system, nor to any destination that requires advance visa completion, including but not limited to formal visa applications or electronic travel authorizations such as eVisas, completed prior to arrival. Guests are solely responsible for ensuring they possess a valid passport with a minimum of six (6) months of remaining validity beyond their scheduled departure date. Denied boarding or entry resulting from an expired, invalid, or insufficiently valid passport does not constitute grounds for a refund or compensation.
7. Age Requirements and Minor Travelers
The individual completing a booking (“Booking Party”) must be at least eighteen (18) years of age and have the legal authority to accept these Terms on behalf of all travelers in the booking. Travelers under the age of eighteen (18) (“Minors”) may participate in a Bela Via trip only if they are accompanied for the full duration of the trip by a parent, legal guardian, or a responsible adult who is at least twenty-one (21) years of age. Bela Via does not arrange or permit travel for unaccompanied Minors. The Booking Party represents and warrants that they have all necessary authority and, where applicable, parental or legal guardian consent for any Minor included in the booking. The accompanying adult assumes full responsibility for the supervision, conduct, and compliance of any Minor during the trip, including meeting all airline, accommodation, destination, and documentation requirements. Bela Via is not responsible for verifying consent or guardianship documentation and reserves the right to decline or cancel any booking involving a Minor if these requirements are not satisfied.
8. Package Delivery & Electronic Access
Bela Via intends to provide physical trip materials through independent third-party delivery providers. While we aim for physical packages to arrive approximately 48–72 hours prior to departure, delivery timelines are not guaranteed. Bela Via is not responsible or liable for delays, loss, damage, or delivery failures caused by third-party carriers, nor for errors in the delivery address provided by the guest. Guests are responsible for monitoring shipment tracking and for promptly notifying Bela Via if a package is delayed, misrouted, or not expected to arrive by the scheduled departure date. In such cases, Bela Via will provide trip information and required documentation electronically to ensure travel can proceed as planned. Failure to monitor delivery status or to contact Bela Via in a timely manner does not constitute grounds for a refund or compensation.
9. Health and Safety Requirements
Guests are responsible for ensuring they meet all health and vaccination requirements for their trip. Bela Via does not provide medical or legal advice.
10. Assumption of Risk
Travel involves inherent risks, including but not limited to illness, injury, accidents, or loss. By participating in a Bela Via trip, guests voluntarily assume all such risks and agree that Bela Via is not liable for any resulting damages or losses.
11. Limitation of Liability
To the maximum extent permitted by law, Bela Via, its founders, employees, contractors, affiliates, and stakeholders shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to the use of our services. To the extent liability cannot be excluded, Bela Via’s total liability shall not exceed the amount paid by the guest for the applicable trip.
12. Bela Via Cancellations and Changes
In the rare event that Bela Via must cancel or significantly alter a trip due to circumstances within its control, Bela Via will notify the guest via the email address on file within 48 hours of becoming aware of the need to cancel or change. In such cases, Bela Via will make reasonable efforts to offer an alternative trip of comparable value or, at its sole discretion, issue a credit toward a future booking. Bela Via's total liability in the event of a cancellation or significant change shall not exceed the amount paid by the guest for the affected trip. Bela Via is not liable for any incidental or consequential costs incurred by the guest as a result of a cancellation or change, including but not limited to costs associated with time off work, childcare, or non-refundable personal expenses made in anticipation of travel.
13. Modifications and Questions
Bela Via reserves the right to update or modify these Terms & Conditions at any time in its sole discretion. Any changes will be effective upon posting. Questions regarding these Terms & Conditions should be directed to info@belaviatravel.com.
14. Governing Law and Acceptance
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the services provided by Bela Via shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties hereby consent to the personal jurisdiction and venue of such courts.

11. Limitation of Liability
To the maximum extent permitted by law, Bela Via, its founders, employees, contractors, affiliates, and stakeholders shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to the use of our services. To the extent liability cannot be excluded, Bela Via’s total liability shall not exceed the amount paid by the guest for the applicable trip.
12. Bela Via Cancellations and Changes
In the rare event that Bela Via must cancel or significantly alter a trip due to circumstances within its control, Bela Via will notify the guest via the email address on file within 48 hours of becoming aware of the need to cancel or change. In such cases, Bela Via will make reasonable efforts to offer an alternative trip of comparable value or, at its sole discretion, issue a credit toward a future booking. Bela Via's total liability in the event of a cancellation or significant change shall not exceed the amount paid by the guest for the affected trip. Bela Via is not liable for any incidental or consequential costs incurred by the guest as a result of a cancellation or change, including but not limited to costs associated with time off work, childcare, or non-refundable personal expenses made in anticipation of travel.
13. Modifications and Questions
Bela Via reserves the right to update or modify these Terms & Conditions at any time in its sole discretion. Any changes will be effective upon posting. Questions regarding these Terms & Conditions should be directed to info@belaviatravel.com.
14. Governing Law and Acceptance
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the services provided by Bela Via shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and the parties hereby consent to the personal jurisdiction and venue of such courts.
